These Terms of Service (“Terms”) govern your use of any mobile game application provided by Orbitech Pte. Ltd. (“Orbitech”, “we”, “us”, or “our”), including all services, content, and functionality offered therein (collectively, the “App”). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, you may not access or use the App.
1. Eligibility
You must be at least 13 years of age (or the minimum age in your country to provide legal consent to data processing) to access or use our App. By using the App, you represent and warrant that you meet these requirements. If you are under the age of 18, you represent that your legal guardian has reviewed and agreed to these Terms on your behalf.
2. License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial use. You agree not to:
- Copy, modify, or distribute the App or any portion thereof
- Reverse engineer or attempt to extract the source code
- Use the App to develop a competing product
- Use any unauthorized software or automated scripts to access or interact with the App
All rights not expressly granted to you are reserved by Orbitech.
3. In-App Purchases
The App is free to download and use; however, certain optional features (such as ad removal) may be available through In-App Purchases (“IAP”). IAPs are processed by the Apple App Store or Google Play Store and are subject to their respective terms.
We do not have access to or store your payment credentials. All sales are final and non-refundable unless otherwise required by law or platform policy. Certain purchases may be tied to your platform account and cannot be transferred between devices or accounts.
4. Advertising and Third-Party Services
We may serve in-app advertisements via third-party ad networks, such as Unity Ads and ironSource. These services may collect and use personal data, such as advertising identifiers and usage behavior, in accordance with their respective privacy policies.
You acknowledge and agree that:
- Ads may appear during gameplay or at transition points
- Ad content is provided by third parties and is not under our control
- Some ads may lead to third-party websites or content, which we do not endorse or guarantee
5. User Conduct
By using the App, you agree that you will not:
- Engage in any illegal, fraudulent, or harmful activity
- Use the App in a manner that could disable, damage, or impair its performance
- Harass, threaten, or defraud other users
- Attempt to gain unauthorized access to other accounts or systems
We reserve the right to investigate and take legal action against users who violate this section.
6. Intellectual Property Rights
All content in the App (including text, graphics, audio, code, and UI design) is the exclusive property of Orbitech or its licensors and is protected by intellectual property laws. No part of the App may be copied, republished, or exploited for any commercial purpose without our prior written consent.
7. Third-Party Links
The App may include links to external websites or services not operated by Orbitech. We are not responsible for the content, policies, or practices of third-party sites. Your use of such services is subject to their own terms and privacy policies.
8. Termination
We reserve the right to suspend or terminate your access to the App at any time and for any reason, including but not limited to a violation of these Terms. Upon termination, your right to use the App will cease immediately. We are not liable for any loss or damage arising from such termination.
9. Disclaimers
The App is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Orbitech disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, secure, or error-free. Your use of the App is at your sole risk.
10. Limitation of Liability
To the fullest extent permitted by law, Orbitech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use or inability to use the App.
In no event shall our total liability exceed the amount you have paid (if any) to use the App in the past twelve months.
11. Modifications
We may update these Terms from time to time. If we make material changes, we will notify you via the App or another method. Continued use of the App after the updated Terms take effect constitutes acceptance of the changes.
12. Governing Law
These Terms are governed by the laws of the Republic of Singapore, without regard to conflict of law principles. Any dispute arising out of or related to these Terms shall be resolved exclusively by the courts of Singapore.
